All About Moser Legal Support: The Essential Guide

Who Moser Legal Support Is

Moser Legal Support is the exclusive service provider for Moser Law’s forensic and litigation support division. A brief history of how Moser Legal Support and Moser Law came to be is discussed below. The facts presented hereafter will also provide some context around the certification program and its mission.
In the late 1990s, well known financial expert Craig Moser became a partner in Moser & Knight CPAs LLP and created a forensic and litigation support division called Moser & Knight Consulting Group ("MKCG"). MKCG soon thereafter began offering corporate-level fraud prevention consulting and fraud investigations.
In 1999, MKCG engaged some high-end marketing developers who worked with Craig Moser and his forensic team to establish an associated certification program for forensic accountants. The forensic accountants would participate in certain Moser & Knight seminars. These events attracted the attention of prominent forensic accounting academics and practitioners. In 2001, the Forensic CPA Society was born. At that time, Craig Moser was named to the founding Board of Directors and served as its first president for two terms . He stepped down from the Forensic CPA Society in 2005 to focus more time on his litigation support business and the development of his own accounting firm. The Society became widely known and well respected in the forensic accounting and litigation support fields.
In late 2010, Moser Law was formed and took over the litigation support division from Moser & Knight. The new firm again turned to Moser & Knight’s founding partnership to develop a supporting group of professionals its clients could turn to when in need of support services not offered by Moser Law. Craig Moser and one of his colleagues from Moser & Knight launched the concept of Moser Legal Support in early 2011.
The mission of Moser Legal Support is to provide clients of Moser Law and others with access to high quality forensic and litigation support professionals with whom Moser Law has previously conducted business. Moser Law charged Moser Legal Support with establishing the qualifications of all its future consultants and providing a centralized clearinghouse for potential clients of Moser Law to learn about the firm’s supporting cast of professionals and to directly request a quote for services from those professionals.

What Moser Legal Support Provides

Moser Legal Support offers a wide variety of services to address the unique needs of their clients. Unlike some other legal support companies that have a preferred process server or do not provide service in-house, Moser Legal Support is directly involved in the job from start to finish, which ensures a better result for the client.
The most requested service is simply serving legal documents. There is a common misconception that this is a simple process that anyone can do, and there is probably some truth to that, but in my experience the skill of the process server is key. Someone with years of experience, like my team, has a better understanding of the various ways people try to avoid being served, the evasive tactics they use, and how to neutralize them. A seasoned professional knows how to handle any number of challenging scenarios.
Moser Legal Support is also accustomed to helping attorneys who are chronically underfunded. Sometimes law firms run into a cash crunch and need to pay bills for services when they don’t have a retainer in place. I have had conversations with colleagues, and was surprised to learn that most traditional process servers generally do not accept partial payment or offer services on credit. They are not able to take these kinds of risks due to the very nature of the business (e.g., the more times you try and serve someone, the more expensive it can become, and if your service isn’t successful, you cannot charge the client).
Moser Legal Support, on the other hand, has built-in financial safeguards. We have preauthorized merchant accounts that essentially guarantee payment for all business conducted through our company. If there is a service that we have done, and a client doesn’t pay, that doesn’t affect our relationship with the merchant services provider. Regardless of whether we can collect from the client, we are guaranteed payment for all business conducted with that client.
For this reason, we are able to accept partial payment, and extend credit—as long as it doesn’t jeopardize our business relationship with the merchant—on a case-by-case basis. We have done this successfully with many clients over the years, and clients have returned when they have challenging cash flow issues. We are happy to help good clients retain their attorneys even when they need some flexibility. This can make a significant impact on their businesses, and I know how much my colleagues appreciate this as well.
We also offer an array of other legal support services including filings and service of process out-of-state, skip tracing, investigations, mobile notary, and court runs.

Client Experiences

For more than a decade, Moser Legal Support has established itself as a trailblazer across the United States for efficient litigation in large complex cases, most notably its work with the LBH Law Group on 1st and 3rd party cases in some of the largest and most sophisticated liability carrier claims.
Of note is the time adjustments Moser Legal had to make during the COVID era and their ability to continue to navigate many challenges that attorneys are faced with in litigating their cases.
One day, I received an email from my law partner, who worked in the Environmental Solutions Division of Morningstar Law Group. This email shared a hostile email conversation between MPLCA and the Environmental Solutions Division of Morningstar Law Group, which involved the need for a short extension to respond to a motion for summary judgment that was due the next day. Morningstar immediately reached out to my law partner to apologize for the email and explain the hostility was due to the fact that the Environmental Solutions Division needed a few days to respond to the motion for summary judgment. At that time, my law partner called me and told me how important it was that we obtain an extension of time. I communicated with Moser Legal representatives that we needed the extension granted because there were multiple reasons for the extension. The attorney and I were able to reach a mutual compromise that existed not just to have Moser Legal get the extension but also that once the extension was obtained we would coordinate attorneys to meet in person and verbally relay the extension of time. To meet our goal, I had an out of state attorney obtain an extension of time to respond to the motion for summary judgment that allowed us two additional weeks. The attorneys also met the next day in person to discuss the case and verbally relay the extension of time . The attorney prepared and filed an answer to the motion for summary judgment within the two weeks of the extension. It was our position that there were additional facts that were being discovered and that the law and facts involved in the case were complex. My understanding of the law was that if there were additional facts discovered, the Court should grant a motion to allow for discovery to be completed. After the answer to the motion for summary judgment was filed, Morningstar’s motion was re-noticed on the court’s calendar for hearing. My law firm brought the motion to re-notice to the attention of Moser Legal representatives. I did not personally attend the hearing but the story goes that the emails and in-person meeting between the attorneys allowed for the motion to be dismissed. A telephone was used in the courtroom. The judge asked the senior attorney if he and the general attorney felt there were additional facts the judge should hear. They agreed. The judge asked if there were any other facts that would cause the judge to take the matter under submission (i.e., the internal decision-making process of the department head, the insurance carrier, and my law firm). We truly believe that it was the goal for the judge to allow the motion to be dismissed but the judge needed the plaintiff to be present. The judge had the law clerk call my office to confirm that I was out of the office and traveling. My assistant contacted me on my cell phone and explained the circumstances. If I had not been out of the office and traveling at that particular time, the judge would have made a mistake. In my opinion, the judge ruled in favor of the law firm. It was a huge win and an incredible feat. Without Moser Legal and the team working with us, I don’t think we would have the same success.
